1. Agreement

By accessing and using Brainwave Beats (the "App"), available through the Apple App Store, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these terms. Under this license, you may not:

• Modify, copy, or create derivative works based on the App or its content
• Use the App or its materials for any commercial purpose or public display
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices from the App
• Transfer the App or your license to another person

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time.

3. Not Medical Advice

Brainwave Beats is a brainwave entrainment tool designed for wellness and entertainment purposes. The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition.

Binaural beats and solfeggio frequencies are provided for personal relaxation, focus, meditation, and sleep support. If you have medical concerns about hearing, neurological conditions, or mental health, please consult a qualified healthcare professional before using the App.

4. Epilepsy and Health Warning

Visual stimuli features within the App may not be suitable for individuals with photosensitive epilepsy or other seizure disorders. If you have a history of seizures, epilepsy, or other neurological conditions, consult your physician before using the App. Use the App at your own discretion and risk.

We recommend using the App at reasonable volume levels to protect your hearing. Prolonged use of headphones at high volume may cause hearing damage.

5. Subscriptions and In-App Purchases

Brainwave Beats offers optional premium features available via in-app subscription. By purchasing a subscription:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase
• No cancellation of the current subscription is allowed during the active subscription period

Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

6. Disclaimer of Warranties

The App and all materials within it are provided on an "as is" basis. We make no warranties, expressed or implied, and hereby disclaim all warranties, including without limitation:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties regarding the accuracy, likely results, or reliability of the App's materials
• Warranties that the App will be uninterrupted, error-free, or free of harmful components

7. Limitation of Liability

In no event shall the developer or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the App, even if the developer has been notified of the possibility of such damage.

8. Accuracy of Materials

The materials appearing in the App could include technical, typographical, or photographic errors. We do not warrant that any of the materials are accurate, complete, or current. We may make changes to the materials contained in the App at any time without notice.

9. Intellectual Property

All content in the App, including but not limited to audio, graphics, user interface designs, icons, and software, is the property of the developer and is protected by applicable intellectual property laws. You may not use, reproduce, or distribute any content from the App without prior written permission.

10. Modifications to Terms

We may revise these Terms of Service at any time without prior notice. By continuing to use the App after changes are posted, you agree to be bound by the revised terms. We encourage you to review these terms periodically.

11. Governing Law

These terms and conditions are governed by and construed in accordance with applicable laws, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
